Osun PDP suffers defeat as Supreme Court dismisses Osun Government’s Local Government allocation suit

The All Progressives Congress (APC) and the Attorney-General of the Federation (AGF) on Friday secured victory at the Supreme Court in a case challenging the control of local government allocations in Osun State.

A seven-man panel of the apex court, led by Justice Baba Idris, delivered the judgment in Abuja.

Reading the lead decision, Justice Muhammad Idris announced that the suit filed by the Osun State Government was dismissed and struck out by a majority decision of 6–1.

In its ruling, the Supreme Court reaffirmed the constitutional autonomy of Nigeria’s three tiers of government, declaring that the federal government cannot interfere in the internal operations of states, just as states cannot interfere in the affairs of local government councils.

The court further held that local governments possess the authority to manage their resources and conduct their activities without undue influence or control from state governments.

Summary: APC and the Attorney-General of the Federation (AGF) won the case.

The Supreme Court dismissed and struck out the suit filed by the Osun State Government with a 6–1 majority decision, meaning the Osun State Government lost the case.
