The Attorney General of the Federation and Minister of Justice, Prince Lateef Fagbemi, SAN, has asked the Federal High Court in Abuja to dismiss a N1 billion fundamental rights enforcement suit filed against him by former Kaduna State Governor, Nasir El-Rufai.
Fagbemi, through his legal team, urged the court to reject the suit on the grounds that it lacked merit and failed to establish sufficient grounds for the reliefs being sought by the former governor.
El-Rufai had instituted the suit against the Attorney General of the Federation and the Independent Corrupt Practices and Other Related Offences Commission, ICPC, in connection with matters concerning the enforcement of his fundamental rights.
The former governor is seeking N1 billion in damages, alleging violations of his constitutional rights in the circumstances that led to the legal action.
However, the Attorney General has challenged the substance of El-Rufai’s claims, asking the court to dismiss the case rather than grant the reliefs sought by the former governor.
The development places the dispute before the Federal High Court in Abuja, where the parties are expected to present their respective legal arguments before the court determines whether El-Rufai’s claims have sufficient merit to proceed.
The case is expected to attract further attention as the court considers the arguments of both sides and determines the next legal steps in the N1 billion fundamental rights suit.
